Privacy Policy

This document contains two parts: (1) a HIPAA Notice of Privacy Practices, required by federal law for all patients receiving health services, and (2) a Website Privacy Policy covering how we collect and use information through jolievisage.com.

PART ONE: NOTICE OF PRIVACY PRACTICES

THIS NOTICE DESCRIBES HOW MEDICAL INFORMATION ABOUT YOU MAY BE USED AND DISCLOSED AND HOW YOU CAN GET ACCESS TO THIS INFORMATION. PLEASE REVIEW IT CAREFULLY. Jolie Visage Rejuvenation Centre ("Jolie Visage," "we," "us," or "our") is committed to protecting the privacy of your health information. This Notice of Privacy Practices describes your rights and our legal duties under the Health Insurance Portability and Accountability Act of 1996 (HIPAA) and its implementing regulations. We are required by law to:

  • Provide you with this Notice of our legal duties and privacy practices
  • Notify you in the event of a breach of your unsecured PHI
  • Follow the terms of the Notice currently in effect

What Is Protected Health Information (PHI)?

PHI is any information we hold about you that relates to your past, present, or future health, the health care services we provide to you, or payment for those services, and that could identify you. This includes your name, address, date of birth, treatment records, prescription history, photographs, and billing information. We collect PHI when you schedule an appointment, receive treatment, pay for services, or communicate with our staff.

How We Use and Disclose Your Health Information

Treatment. We use and share your PHI to provide you with medical and aesthetic care. For example, our providers share treatment notes when coordinating your Botox, hormone therapy, weight loss program, IV therapy, or other services. We may share your records with outside providers who assist in your care (such as labs or referring physicians) when necessary. Payment. We use and share your PHI to bill for services and collect payment. This includes sharing information with your insurance company (if applicable), payment processors, or third-party billing services. Health Care Operations. We use and share your PHI to run our practice effectively. This includes quality reviews, staff training, compliance activities, and business planning. As Required by Law. We will share your PHI when required by federal, state, or local law. This includes reporting certain communicable diseases to public health authorities, reporting suspected abuse or neglect, and complying with court orders or subpoenas. Public Health and Safety. We may share your PHI to prevent a serious threat to your health or safety or the health or safety of others. Government Oversight. We may share PHI with government agencies for oversight activities, audits, inspections, or investigations as required by law. Law Enforcement. Under certain circumstances, we may share PHI in response to a court order or a warrant. Workers' Compensation. We may share PHI as necessary to comply with workers' compensation laws or similar programs.

Uses and Disclosures That Require Your Written Authorization

We will not use or share your PHI for any purpose other than those described above without your written authorization, except as permitted or required by law. Uses that require your prior written authorization include:
  • Marketing communications — if we are paid to promote a product or service to you
  • Sale of your PHI — we will not sell your health information
  • Most uses of psychotherapy notes (if applicable)
  • Any other use or disclosure not described in this Notice
You may revoke any written authorization at any time, except to the extent we have already acted on it. To revoke an authorization, submit your request in writing to the contact information listed below.

Your Rights Regarding Your Health Information

Right to Access Your Records. You have the right to inspect and obtain a copy of your PHI held in our designated record set. To request access, submit a written request to us. We may charge a reasonable cost-based fee for copies. We will respond within 30 days. Right to Request Amendment. If you believe PHI we hold about you is incorrect or incomplete, you may request an amendment. We are not required to agree to the amendment, but we will respond to your request within 60 days and document any disagreement. Right to an Accounting of Disclosures. You may request a list of disclosures we have made of your PHI for purposes other than treatment, payment, or health care operations. Requests must be made in writing. We will respond within 60 days. Right to Request Restrictions. You may ask us to limit how we use or share your PHI for treatment, payment, or health care operations. We are not required to agree to most restrictions, but if we agree, we will honor that restriction. Exception: we must agree to a restriction if you pay out-of-pocket in full and ask us not to share the information with your health plan. Right to Request Confidential Communications. You may ask us to contact you in a specific way or at a specific location — for example, only by phone to a number you provide. We will accommodate all reasonable requests. Right to a Paper Copy of This Notice. You may request a paper copy of this Notice at any time, even if you have agreed to receive it electronically. Right to Be Notified of a Breach. If we discover that your PHI has been improperly used or disclosed in a way that compromises its security or privacy, we will notify you as required by law.

Our Duties

We are required by law to maintain the privacy of your PHI and to provide you with this Notice. We reserve the right to change our privacy practices and the terms of this Notice at any time, as permitted by law. Changes will apply to PHI we already hold, as well as any PHI we receive after the change takes effect. The revised Notice will be posted in our office and on our website. You may request a copy of any revised Notice at any time.

PART TWO: WEBSITE PRIVACY POLICY

This section explains how Jolie Visage collects and uses information through our website, jolievisage.com.

Information We Collect

Information you provide. When you use our contact form, request an appointment, or subscribe to our communications, you may provide your name, email address, phone number, and message content. We use this information only to respond to your inquiry or fulfill your request. Automatically collected information. Like most websites, ours automatically collects certain technical information when you visit, including your IP address, browser type and version, pages viewed, time spent on each page, referring website address, and device type. This information helps us understand how visitors use our site and is not combined with your clinical PHI without your consent.

Cookies

Our website uses cookies — small text files stored on your device — to improve your experience. We may use session cookies (expire when you close your browser), preference cookies (remember settings you have selected), and analytics cookies (aggregate, anonymized visitor behavior data). Third-Party Services

Marketing Communications

Email Communications. If you provide your email address, we may send you appointment reminders, health tips, and promotional information about our services. Every marketing email includes an unsubscribe link. We will honor unsubscribe requests promptly. Consent to receive marketing emails is not a condition of receiving our services. Text Message (SMS) Communications. We may send text messages — including appointment reminders, health tips, and promotional offers — only to individuals who have provided their explicit prior written consent to receive such messages from Jolie Visage Rejuvenation Centre. Consent to receive text messages is not a condition of purchase or of receiving any service. When you opt in to receive text messages, you will be informed of:
  • The types of messages you will receive
  • Message frequency (message frequency varies)
  • The fact that message and data rates may apply
  • How to opt out and how to get help
How to Opt Out of Text Messages. You may opt out of text messages at any time by replying STOP to any message you receive from us. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with any third parties, except for aggregators and providers of the text message services used to deliver messages on our behalf. All other data-sharing categories described in this policy exclude text messaging originator opt-in data and consent. Email and General Contact Data. We do not sell, rent, or trade your email address or other contact information to third parties for their own marketing purposes.

How We Protect Your Information

We use reasonable physical, technical, and administrative safeguards to protect the information we collect through our website. For your clinical health records, our security practices are governed by HIPAA's Security Rule, including encryption of electronic PHI and access controls limiting who can view your records.

Children's Privacy

Our website is not directed to individuals under 18. We do not knowingly collect personal information from individuals under 18. If you believe a minor has provided us with personal information, please contact us and we will delete it.

Changes to This Policy

We may update this Privacy Policy periodically to reflect changes in law, our practices, or the services we offer. The effective date at the top of this page will reflect when changes were last made.
